FROM THE MIMBAR OF SHAYKH TAHIR WYATT

Shakyh Tahir Wyatt consults with many scholars of Islam and is often asked to advise others. Here is he supports from what the foremost scholars have to say concerning the Corona Virus and its results termed "COVID-19". 

أصدرت هيئة كبار العلماء قرارها رقم ( 246 ) في 16 / 7 / 1441هـ، فيما يلي نصه:-

The Body of Senior Scholars issued its resolution No. 246 on 16/7/1441 H, stating the following:

:الحمد لله رب العالمين، والصلاة والسلام على نبينا محمد وعلى آله وصحبه أجمعين، أما بعد

All praise is due to Allāh the Lord of all creation. May Ṣalāh and Salām be upon our Prophet Muḥammad and upon his Family and all of his Companions. To proceed:

فقد نظرت هيئة كبار العلماء في دورتها الاستثنائية الرابعة والعشرين المنعقدة بمدينة الرياض يوم الأربعاء الموافق 16 / 7 / 1441هـ فيما عرض عليها بخصوص الرخصة في عدم شهود صلاة الجمعة والجماعة في حال انتشار الوباء أو الخوف من انتشاره، وباستقراء نصوص الشريعة الإسلامية ومقاصدها وقواعدها وكلام أهل العلم في هذه المسألة فإن هيئة كبار العلماء تبين الآتي:

The Body of Senior Scholars examined in its 24th special session held in Riyadh on Wednesday, 16/7/1441 H, what was presented to them regarding the concession to not attend Ṣalāt-ul-Jumuʿah or the congregational Ṣalāh due to the spread of the pandemic or the fear of its spread. By thoroughly studying the texts of Islamic law, its purposes and principles, as well as the speech of Scholars in this matter, the Body of Senior Scholars states the following: 

أولاً: يحرم على المصاب شهود الجمعة والجماعة لقوله صلى الله عليه وسلم ( لا يورد ممرض على مصح ) متفق عليه، ولقوله عليه الصلاة والسلام: ( إذا سمعتم الطاعون بأرض فلا تدخلوها وإذا وقع بأرض وأنتم فيها فلا تخرجوا منها ) متفق عليه.

Firstly, it is forbidden for the afflicted to attend Jumuʿah and the congregational prayers due to his ﷺ statement: “No sick camel should be placed with a healthy one.” [Agreed upon] Also, due to his ﷺ statement: "If you hear of the plague in a land do not enter it, and if it falls into a land you are in, then do not go out of it.” [Agreed upon]

ثانياً: من قررت عليه جهة الاختصاص إجراءات العزل فإن الواجب عليه الالتزام بذلك، وترك شهود صلاة الجماعة والجمعة ويصلي الصلوات في بيته أو موطن عزله، لما رواه الشريد بن سويد الثقفي رضي الله عنه قال: (كان في وفد ثقيف رجل مجذوم فأرسل إليه النبي صلى الله عليه وسلم إنا قد بايعناك فارجع) أخرجه مسلم.

Secondly, if the competent authorities make a decision concerning an individual, it is obligatory for him to abide by that decision and leave attending the congregational prayers and Jumuʿah and pray the prayers in his home or the place of his isolation, because of what is narrated by Ash-Sharīd ibn Suwayd Ath-Thaqaqī رضي الله عنه who said: “Among the delegation of Thaqīf there was a leper. The Prophet ﷺ sent word to him saying: ‘We have accepted your oath of allegiance; now go back.’” [Reported by Muslim]

ثالثاً: من خشي أن يتضرر أو يضر غيره فيرخص له في عدم شهود الجمعة والجماعة لقوله صلى الله عليه وسلم: ( لا ضرر ولا ضرار) رواه ابن ماجه. وفي كل ما ذكر إذا لم يشهد الجمعة فإنه يصليها ظهراً أربع ركعات.

Thirdly, whoever is afraid that he will be harmed or harm others, then it is permissible for him to not attend Jumuʿah and the congregational prayers because he ﷺ said: "There is no harm nor reciprocation of harm." [Narrated by Ibn Mājah] And in all of what was mentioned, if he does not attend Jumuʿah, he will pray Dhuhr as four rakʿats [instead].

هذا وتوصي هيئة كبار العلماء الجميع بالتقيد بالتعليمات والتوجيهات والتنظيمات التي تصدرها جهة الاختصاص، كما توصي الجميع بتقوى الله عز وجل واللجوء إليه سبحانه بالدعاء والتضرع بين يديه في أن يرفع هذا البلاء قال الله تعالى: ( وإن يمسسك الله بضر فلا كاشف له إلا هو وإن يردك بخير فلا راد لفضله يصيب به من يشاء من عباده وهو الغفور الرحيم )، وقال سبحانه: ( وقال ربكم ادعوني استجب لكم )، وصلى الله وسلم على نبينا محمد وعلى آله وصحبه أجمعين.

The Body of Senior Scholars urges that everyone abide by the instructions, directives and regulations issued by the competent authorities, just as it advises everyone with the piety of Allāh ﷻ and taking refuge in Him - Glorified is He - by supplicating and imploring in front of Him to remove this ordeal. Allāh the Most High said: "If Allāh touches you with harm, then none can remove but He; and if He intends any good for you, there is none who can repel His Favor, which He causes to reach whoever from His slaves He wills. And He is Oft-Forgiving, Most Merciful.” He ﷻ also said: "Your Lord said, ‘Call on Me and I will answer you.’” May Ṣalāh and Salām be upon our Prophet Muḥammad and upon his Family and all of his Companions.
